Private and Informed Consent Policy

    • The Ayurvedic practice comes from thousands of years of knowledge built from traditional healing systems from India, focusing on the unique path each person must pursue towards achieving optimal health. The guidance provided by your Ayurvedic Counselor is based on their understanding of your individual constitution and any potential imbalances. Your health program may involve lifestyle changes, varying degrees of dietary recommendations, the support of spices for your treatments, and Ayurvedic body Practices.

    • The Counselor guiding your Ayurvedic journey is not a licensed medical doctor, or a nationally certified massage therapist, and therefore does not offer advice that would alter your existing, or potentially existing, medical care. Giovana Malufe is trained as an Ayurvedic Yoga Specialist and an Ayurvedic Lifestyle Consultant Ayurvedic Counselor, as certified by [the Boston School of Ayurveda. She is also trained as a holistic Health Coach certified by the Institute of Integrative Nutrition and is pursuing a Doula Certification through Uncovering Birth. It is important to note that Ayurveda is recognized in the United States as a complementary and alternative medicine.

 

Limitation of Liability

  • To the fullest extent permitted by applicable law, Giovana Malufe and any affiliated partners, employees, or agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of income, emotional distress, or physical harm, arising out of or related to:

  • Your use of or inability to use the counseling services provided, including any advice, recommendations, or guidance offered during sessions.

  • Any health-related outcomes or changes resulting from the application of advice or recommendations provided during counseling sessions. You acknowledge that results may vary based on individual circumstances and adherence to the guidance given.

  • Any services or products recommended or referred to by Giovana Malufe, including but not limited to their quality, safety, effectiveness, or appropriateness.

  • Any temporary or permanent interruptions, suspensions, or terminations of counseling services due to unforeseen circumstances or necessary adjustments.

  • Giovana Malufe does not guarantee specific health outcomes or results from counseling services. The services are intended to support your health and wellness journey but are not a substitute for professional medical advice, diagnosis, or treatment.

  • In no event shall Giovana Malufe’s total liability to you for any claims arising from or related to the counseling services exceed the total amount you paid for services during the three (3) months preceding the date of the claim.

  • Counseling services are provided "as is" and "as available," with no warranties, express or implied, including but not limited to implied warranties of fitness for a particular purpose or non-infringement. You acknowledge that you are solely responsible for your health decisions.

  • Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for certain damages. Therefore, some of the above limitations may not apply to you. In such jurisdictions, Giovana Malufe’s liability is limited to the maximum extent permitted by law.

  • Ayurveda does not diagnose or treat pathological conditions as defined by Western medicine. Instead, the focus is on enhancing the body’s natural ability to maintain itself healthy and balanced. By participating in an Ayurvedic health program or bodywork session, you acknowledge and understand this approach, and accept full responsibility for your health decisions and outcomes. You further agree to release the practitioner and associated entities from any liability for any adverse effects you may associate with your care. 

  • If you have any undiagnosed symptoms or conditions, it is strongly recommended that you seek a formal evaluation from a licensed healthcare provider. While your Ayurvedic practitioner may assess your vital signs and perform certain examinations, these are interpreted through the lens of Ayurveda, and not that of conventional Western medicine, and do not replace a medical examination.

  • We collect personal information from you in various ways, including when you register on our website, complete surveys, communicate with us, or place orders for products or services through any of our channels. This information may be gathered during online interactions or other forms of communication.   • If you cancel a service that has already commenced, you may only be eligible for a partial refund based on the portion of the service that was delivered.

  • Certain services are non-refundable, including but not limited to consultation fees, administrative fees, and any services explicitly marked as non-refundable at the time of purchase.

 

Returns and Refunds

  • We strive to provide exceptional service and aim to ensure your complete satisfaction. However, if you are not satisfied with the service provided, you may be eligible for a refund or cancellation under the following conditions:

  • Refund requests must be made within 14 days of the service date. After this period, refunds may not be available.

  • Refunds are generally issued for services not rendered as agreed or if the service did not meet the outlined expectations as per our agreement.
